Welcome to KoolSchool! These Terms of Service ("Terms") govern your access to and use of KoolSchool’s website, applications, AI tools, and related services ("Services"). By accessing or using KoolSchool, you ("User," "Teacher," "Student," "School," or "Administrator") agree to be bound by these Terms.

1. Account Eligibility & Responsibilities

Institutional Accounts: If you are using KoolSchool on behalf of a school, school district, or educational institution, you represent and warrant that you have the authority to bind that institution to these Terms.
Account Security: Users are responsible for maintaining the confidentiality of their login credentials. Any activity under your account remains your responsibility.
Student Usage: Students may access KoolSchool under the authorization of teachers or educational institutions that have obtained necessary parental or institutional consent.

2. User Content & Intellectual Property Ownership

Your Content Remains Yours: You retain full ownership of all materials, prompts, lesson plans, documents, student coursework, and chat transcripts ("User Content") uploaded or created within KoolSchool.
License to KoolSchool: You grant KoolSchool a non-exclusive, worldwide, royalty-free license to host, process, and display User Content solely for the purpose of operating, rendering, and maintaining the Services for you.
KoolSchool Ownership: KoolSchool retains all rights, title, and intellectual property in and to the platform, including software, design, user interface, brand assets, and proprietary features.

3. Artificial Intelligence & Student Interaction

Direct Student AI Interactions: KoolSchool provides real-time AI tools (e.g., AI tutors, automated feedback, interactive practice) that communicate directly with students. Users acknowledge that AI systems process natural language probabilistically and may occasionally output incorrect, incomplete, or unexpected information ("hallucinations").
User Discretion & Institutional Monitoring: Students and educators are advised to evaluate AI outputs critically. While KoolSchool implements content filters, safety guardrails, and administrative oversight logs for teachers, KoolSchool does not guarantee that AI outputs will always be error-free or perfectly accurate.
No Model Training: Per our Privacy Policy, KoolSchool does not use private user content or student conversations to train public or proprietary foundation models.

4. Service Availability, Maintenance, and Software Modifications

"As-Is" and "As-Available" Service: KoolSchool is provided on an "AS IS" and "AS AVAILABLE" basis. We do not guarantee uninterrupted, secure, or error-free operation of the platform.
Maintenance & Downtime: We reserve the right to modify, suspend, or temporarily interrupt access to the platform (or specific features) at any time for routine maintenance, security updates, or emergency infrastructure fixes without prior liability.
Software Bugs & Beta Features: You acknowledge that software may contain bugs, defects, or minor errors. KoolSchool continuously works to resolve identified issues but makes no express warranty regarding bug response times or absolute software perfection.

5. Acceptable Use Policy

Users agree not to:

Use KoolSchool to generate harmful, illegal, abusive, harassing, or sexually explicit content.
Reverse engineer, decompile, or attempt to extract the source code or underlying AI models of the platform.
Bypass access controls, scrape data, or introduce malware and malicious code into the system.
Use the platform to impersonate others or falsify educational records.

6. Termination & Data Retrieval

Termination by You: You or your school district may stop using KoolSchool at any time by closing your account or terminating your enterprise contract.
Termination by Us: KoolSchool reserves the right to suspend or terminate access if a user repeatedly or egregiously violates these Terms.
Data Retrieval: Upon contract termination or account closure, school districts may request an export of their educational records within 30 days, after which data will be permanently deleted per our retention schedules.

7. Warranty Disclaimer & Limitation of Liability

Warranty Disclaimer: TO THE MAXIMUM EXTENT PERMITTED BY LAW, KOOLSCHOOL DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Limitation of Liability: KOOLSCHOOL SHALL NOT BE LIABLE FOR ANY DAMAGES RESULTING FROM PLATFORM DOWNTIME, LOSS OF DATA, BUGS, SERVICE DISRUPTIONS, OR INACCURACIES IN AI-GENERATED CONTENT. IN NO EVENT SHALL KOOLSCHOOL’S AGGREGATE LIABILITY EXCEED THE FEES PAID BY YOU TO KOOLSCHOOL IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
